Saxton & Stump’s expertise includes litigation and investigation in heater-cooler devices, which in October 2015, the FDA and Pennsylvania Department of Health advised health care providers and the public of a potential risk for aerosolized Mycobacterium chimaera, a specific strain of non-tuberculous mycobacterium, from heater-cooler devices during certain open heart surgeries. Saxton & Stump’s attorneys and clinicians have focused on this new and developing phenomenon since the fall of 2015, and continue to do so. They are knowledgeable in FDA, CDC and Department of Health’s recommendations and communications addressing this issue, as well as scientific and medical literature and research addressing atypical mycobacterium. Additionally, they are well informed about research being conducted into the aerosolization of Mycobacterium chimaera from heater-cooler devices and Stӧckert/Sorin 3T Heater-Cooler Device Operating Instructions and Field Safety Notices. The dedicated team utilizes this unique knowledge to assist and counsel health care systems, hospitals and clinicians. Saxton & Stump is currently working on pending cases involving these alleged infections.
