Saxton & Stump secured a defense verdict on behalf of a surgeon who performed an abdominal procedure to remove a non-functioning peritoneal dialysis catheter (PDC) and place new one. The procedure involved divisions of dense adhesions. A bowel perforation was discovered and repaired during a take back procedure seven days later. Plaintiff claimed the perforation occurred during the PDC procedure, was not timely detected, and was not properly addressed when detected, necessitating numerous repair surgeries over the next several months. Through the testimony of a highly qualified expert witness, a former Chair of the American Board of Surgery, we proved the patient experienced a delayed bowel perforation, which was unpredictable and unpreventable, and was appropriately addressed when symptoms presented.
