Saxton & Stump Trial Attorneys Obtain Defense Verdict in Case Involving a Neurosurgeon

We won a defense verdict in a case involving a neurosurgeon who successfully performed minimally invasive spine surgery, following which his patient suffered a cardiorespiratory arrest and died.  Plaintiff claimed that the neurosurgeon should have ordered post-operative telemetry and oxygenation monitoring despite the patient’s stable status and relied on conclusions reached by a coroner on cause of death.  At trial, the defense presented expert testimony from a cardiologist who established an alternate explanation for the cause of the patient’s death, and a neurosurgery expert who testified that defendant’s post-operative monitoring decisions were within the standard of care.  The jury found no negligence on the part of the physician.
