Saxton & Stump’s Dr. Kevin H. Mosser, a family physician with extensive geriatric experience and former healthcare executive, and attorney Collin T. Keyser, chair of the Senior Care Services group, presented “Best Practices Upon Admission for Managing Risk and Reducing Liability Later On” during the LeadingAge PA Annual Conference + EXPO virtual experience. The presentation covered innovative techniques for senior care facilities to mitigate liability risk and improve family and resident engagement and best practices for the admissions process.
Across Pennsylvania, the frequency and severity of long-term care claims are on the rise. What once were areas of care overlooked by the Plaintiffs’ bar, assisted living and personal care communities have become a focus of litigation. One of the central themes in these cases is that negligence occurred because the community did not place the resident in the appropriate level of care at the time of admission. Once a lawsuit is filed, Power of Attorneys who were actively involved in the admission process often conveniently forget the extent of their involvement in the process, and their expressed desire for their loved one to live in an environment with more independence.
In the session, Mosser and Keyser looked beyond the admission agreement and evaluated innovative techniques that admissions teams can undertake to mitigate liability risk and improve family and resident engagement in the admissions process. They also reviewed key admission documentation tools that can become powerful exhibits during litigation. Mosser provided insight on best practices the community can implement when resident admission medical evaluations are performed by clinicians who are not credentialed or affiliated with the community.
Finally, Mosser and Keyser provided real life case excerpts to illustrate how the Plaintiffs’ bar prosecutes claims against personal care and assisted living communities and how these innovative risk mitigation techniques can help combat claims when litigation cannot be avoided.
