“I Was Sued… Now What?!” was recently published in Lancaster Physician Magazine’s winter 2020 edition. The article completes the two-part series by attorneys James W. Saxton, CEO, and Darlene K. King, Chair of Saxton & Stump’s Risk Mitigation & Safety Group. In the series, which focuses on practicing medicine in the current legal climate, Saxton and King explore the likelihood of facing a medical malpractice suit at some point in time. According to statistics, most physicians will likely face at least one claim in their career, with general surgeons and obstetricians/gynecologists being the most likely to face a lawsuit. While lawsuits are unfortunately common, it is important for physicians to know they are not alone and to take the proper steps when working through the process. Additionally, the article reinforces the importance of open communication and thorough documentation to enhance the patient-physician experience and lessen the risk of a claim, as previously addressed in part one “Providers: Take Steps to Enhance Patient Engagement and Prevent Lapses That Lead to Lawsuits.”
