Saxton & Stump successfully secured a non-suit on all claims against its hospital clients following the close of Plaintiffs’ case in chief at trial. Plaintiff experienced a stroke presented to the defendant hospital for evaluation and treatment. Following the resolution of symptoms, Plaintiff was discharged with prophylactic medication and plans for additional care. Plaintiff experienced a second neurological event and represented to the hospital. Plaintiffs’ claims focused on alleged failures to appropriately evaluate and treat Plaintiff so to prevent the second neurological event. After multiple days of hearing Plaintiffs’ case in chief, the Court entered non-suit for Defendants due to Plaintiffs’ experts testimony on cross-examination resulting in failure to establish their threshold burden at trial.
