We represented a hospital and a general surgeon in a 5-day wrongful death trial involving allegations that the surgeon, anesthesiologist, and anesthetist failed to timely recognize, diagnose, and treat an evolving pericardial effusion and ensuing cardiac tamponade during the placement of porta-a-cath. The patient suffered cardio-respiratory arrest resulting in anoxic brain injury and subsequent death. We successfully obtained a non-suit on the direct allegations of negligence against the hospital. Following the close of evidence, we also obtained a non-suit in favor of the hospital as to all claims arising out the alleged negligence of the hospital’s employees and ostensible agents. After 5 hours of deliberation, the jury returned a defense verdict of no negligence in favor of the defendant surgeon as well.
