Saxton & Stump attorneys successfully proved that a residential development in Columbia County caused a massive diversion of stormwater onto their client’s property, resulting in more than $450,000 in damages awarded by the court.
The client experienced persistent water runoff issues from 2010 to 2021 stemming from construction activity associated with a residential development in Scott Township, just outside Bloomsburg, Pennsylvania. Over time, the redirected runoff caused extensive damage to his property.
The court sided with Saxton & Stump’s position that the development’s construction was the source of the stormwater diversion and ordered the defendant to pay the client $452,000 in damages. The award included approximately $413,200 for property repairs and nearly $40,000 to cover expert witness costs.
The case was litigated by Ronald H. Pollock, co-chair of the Saxton & Stump Construction Law Group, and Aaron M. Scheibelhut with paralegal support from Ellen M. Palmer. Charles Rapp, the firm’s director of information technology, created a critical video montage of the site that played a key role in clearly demonstrating the extent and cause of the damage.
