Saxton & Stump secured a defense verdict in a case against a family medicine physician involving the death of a 45-year old from a heart attack while jogging. Plaintiff claimed that our client and his physician assistant failed to recognize that the patient’s complaints of chest pain and shortness of breath on exertion made several months earlier were symptoms of the coronary artery disease found at autopsy and failed to order further testing to diagnose and treat the cardiac condition. Through our client and strong expert support, we were able to demonstrate to the jury that the patient’s prior complaints were not cardiac in nature and that the anatomic findings at autopsy confirmed the heart attack was due to a sudden, unpreventable, and unpredictable atherothrombotic plaque rupture. After a week-long trial, the jury agreed with the defense, found that our client’s treatment plan was reasonable, and returned with a no negligence verdict in approximately 45 minutes.
