Louis G. Fiorilla is a shareholder and chair of the firm’s Banking and Financial Services group. He is also a member of the firm’s Franchise Litigation, Business Litigation and Strategic Solutions, Real Estate, Business and Corporate and Death Care groups.
Lou represents national businesses, franchisors, distributors, and internet and financial services companies in contract, consumer protection, fraud, and intentional tort suits. He also has significant plaintiff-side experience prosecuting breach of contract and franchise agreement actions concerning the wrongful use of intellectual property and trade secrets.
Lou frequently litigates the enforceability of online services terms and account agreements, including arbitration clauses and liability limitations. He also litigates real estate and commercial lease and eviction disputes.
He defends financial services companies in consumer protection actions, including single-plaintiff and class action lawsuits, alleging violations of the Telephone Consumer Protection Act, Fair Credit Reporting Act, Fair Debt Collection Practices Act and state law analogs. Lou also provides strategic analysis of financial services companies’ compliance with consumer protection statutes and state mortgage servicing and foreclosure laws.
Prior to joining Saxton & Stump, Lou was a partner at an Am Law 200 firm in Atlanta, GA. While in law school, Lou served as a law clerk for the Hon. George A. Pagano at the Delaware County Court of Common Pleas in Pennsylvania.
