Construction project losses related to COVID-19 – Jeff Bright explains claims in ABC Keystone
Saxton & Stump attorney Jeffrey C. Bright recently published “Types of Claims that May Arise from Construction Project Losses Related to COVID-19” in the June 2020 issue of The Merit Shop Spokesman ABC Keystone Newsletter for their Ask an Attorney series. In the article, Jeff discusses contract clauses and potential claims that may cover losses associated with the arising COVID-19 pandemic for contractors and subcontractors as construction projects move forward.
During the pandemic, construction projects were unexpectedly put on hold or delayed, which lead contractors and subcontractors to lose important time and money. Jeff explains in detail the different claims that construction companies can potentially take advantage of and how evaluating contract clauses or other potential claims can help contractors to recoup losses.
When it comes to construction project schedules and costs, “COVID-19 is the elephant in the room,” explains Jeff. To keep projects moving, he suggests contractors and subcontractors identify and document the loss and its cause. Jeff then suggests seeking legal counsel to review the project contract to potentially pursue any claims that cover the loss.
