Pennsylvania’s Commonwealth Court voids PennDOT’s Major Bridge P3 Initiative

Today, the Commonwealth Court issued a memorandum Opinion finding PennDOT’s Major Bridge P3 Initiative void ab initio, declaring the initiative had no legal effect from the very beginning because the initiative was approved in violation of Act 88. Act 88 is the act that governs the process by which any government agency may enter into agreements with private entities.

Saxton & Stump attorneys Mike Traxler and Katy Landis, on behalf of the Pennsylvania Motor Truck Association, filed an amicus curiae brief opposing the initiative that would have tolled nine bridges across the Commonwealth and opened the door for PennDOT to toll more bridges and interstates in the future. This ruling by the Commonwealth Court is a significant victory for the trucking industry.
