Ashley B. Nichols, Esq. focuses her practice on business and commercial litigation in the construction and labor industries as well as appellate and post-trial advocacy.

In the construction arena, Ashley litigates all types of construction claims, including claims for lost profits and delay damages, and warranty and workmanship claims. Ashley drafts and reviews contracts in an effort to mitigate lawsuits. She also provides counseling and claims avoidance advice. She participated in the American Bar Association’s Forum on Construction Law Trial Academy, a rigorous training program that focuses on trial skills and is instructed by accomplished construction litigation experts.

Ashley also counsels business owners and employers on wage and hour issues concerning the Pennsylvania Minimum Wage Act, the Pennsylvania Wage Payment Collection Law, the Fair Labor Standards Act, and independent contractors. She advises employers on Occupational Safety and Health Administration (OSHA) audits, compliance and whistleblower complaints, and workers’ compensation claims. She regularly reviews employee policies and handbooks.

Additionally, Ashley has experience representing doctors, hospitals, and other healthcare providers in medical and professional liability cases. She has defended cases both at the trial and appellate court levels. Prior to joining Saxton & Stump, she served as an Associate in the Construction and Procurement group of a large law firm based in Harrisburg. She litigated complex construction and procurement claims before the state, federal, and appellate courts including the Pennsylvania Board of Claims. She regularly advised business owners on contract drafting and negotiation, public bidding requirements, and mechanics’ lien and payment bond issues.

In 2015, Ashley was recognized by her peers as a Central Pennsylvania Select Lawyer in Construction law. She was a co-author of Applying the Procurement Code: Problem Areas and the Need for Future Direction, The Pennsylvania Bar Association Quarterly, Oct. 2014. Ashley is a member of Associated Builders and Contractors, Inc., – Keystone Chapter and the Lancaster Society for Human Resource Management. She volunteers for the Lancaster Bar Association’s Wills for Heroes events. Ashley began her legal career as a law clerk to the Honorable Sallie Updyke Mundy of the Superior Court of Pennsylvania and the Honorable Richard A. Gray of the Lycoming County Court of Common Pleas.
