Senior Counsel

Maureen Gimpel Maley is Senior Counsel for the firm’s Labor and Employment and Internal Investigations Groups. Maureen brings more than 25 years of legal experience, including 15 years as in-house counsel, to the firm. She has significant knowledge of employment law, litigation, internal investigations, risk management and contract negotiation. Maureen also serves in the firm’s Business and Corporate, Healthcare, Senior Care Services and Hospitality Groups.

Previously, Maureen was Vice President and Deputy General Counsel of Employment and Litigation for one of the nation’s largest post-acute care providers, where she advised on legal matters impacting long-term care and therapy services at more than 1,000 locations in 47 states. In this role, she managed an in-house team of employment attorneys and paralegals, as well as outside counsel, with a multi-million-dollar budget. Maureen also handled and resolved employment and commercial disputes, consulted on day-to-day human resources operations and developed training programs on a variety of topics.

Most recently, Maureen was Vice President of Employment and Business Affairs at a leading regional gaming operator. In this role, she advised the corporate team and operators of 41 gaming and racing facilities, including more than 100 hotels and restaurants, on all aspects of employment law.

After she received her J.D and LL.M from Duke University School of Law, Maureen began her career with Dechert Price & Rhoads (now Dechert LLP) in Philadelphia.

Fifteen years of experience as in-house counsel to health care (including acute care, long term care, pharmacy, medical device, physician services, home health care, rehabilitation therapy providers), hospitality and gaming clients

Conducted and supervised investigations of allegations involving workplace misconduct, including harassment, theft, abuse, retaliation, discrimination, and other matters

Designed and delivered training on harassment, wage and hour compliance, FMLA compliance, ADA and the interactive process, social media issues in the workplace, HIPAA, basics of contract law, and other employment and contract law matters

Advised on all areas of employment law, including day-to-day human resource operations (recruitment, eligibility to work, hiring, employee benefits, performance management, corrective action, discipline, and termination, as well as organizing activity and union contract terms) and on compliance with laws and regulations including Title VII, FMLA, ADAAA, ADEA, OWBPA, WARN, FCRA, OSHA, FLSA, IRS classification rules, I-9 rules, NLRA

Drafted and counseled on employer policies and procedures and employee handbooks

Managed defense of multiple wage and hour class action lawsuits, resulting in both successful mediations and dismissal of claims, including a defense decision from the United States Supreme Court

Managed and resolved hundreds of employment and commercial lawsuits through early assessment and resolution, negotiation, mediation, or litigation to judgment, obtaining numerous defense judgments

Supported in-house law departments in restructurings and other large projects

Advised on domestic and international commercial transactions, including commercial leases, purchase/lease agreements, HRIS and other operational agreements, and acquisition and sale of businesses and business interests
