Rebecca A. Finkenbinder, Esq. has the ability to identify and develop innovative solutions to manage risks for intellectual property and corporate and business matters. She has strong knowledge in the areas of trademarks, copyrights, marketing/advertising/branding, franchise law, social media, and Internet law. She has also served as in-house IP counsel for a number of private companies.

Throughout her career, Rebecca has represented the food and beverage industry, specifically food manufacturers, growers, processors, and distributors; the hospitality industry; the entertainment industry; consumer and industrial goods and services companies; technology firms; and educational institutions by protecting their valuable trademarks, patents, and copyrighted works.

In her Intellectual Property practice, she has presented numerous arguments to the United States Patent and Trademark Office in support of securing trademark registration. She has instituted and defended opposition, cancellation, and concurrent use proceedings before the Trademark Trial and Appeal Board. She also represented clients before the National Arbitration Forum and the National Advertising Division of the Better Business Bureau (BBB). Utilizing her knowledge of the food and beverage industry, Rebecca has counseled clients on Federal Trade Commission and The Food and Drug Administration regulations.

Prior to earning her law degree from The Pennsylvania State University Dickinson School of Law, Rebecca earned her bachelor’s degree in Marketing and her Master of Business Administration (MBA). This background gives her a unique understanding of marketing, advertising, branding, franchise law, social media, and Internet law. To ensure her clients are compliant with government regulations, Rebecca reviews and advises on branding strategies, marketing materials, product claims, and advertising campaigns. She also has prepared and negotiated favorable terms and agreements for strategic alliances including:

  • Joint ventures
  • Non-disclosure agreements
  • Supply and vendor sales and distribution agreements
  • Private label agreements
  • Advertising agency and marketing service agreements
  • Technology agreements

She counsels clients on the issues of labeling, endorsements and testimonials, claim substantiation, and comparative and false advertising.

Rebecca also provides counseling services to clients seeking to franchise their business including preparation of franchise and area development agreements, franchise disclosure documents, franchise termination, and compliance with state and federal laws. Rebecca’s experience managing federal and state law compliance for various franchises includes restaurants, alternative energy sources, residential/commercial painting, commercial cleaning, and assisted living care services.
