Saxton & Stump Team Obtain Defense Verdict in Involving an Alleged Delayed Diagnosis of Bacterial Meningitis in an Infant

Our trial attorneys successfully defended several pediatrics providers and emergency department physician against claims that they failed to recognize an evolving serious bacterial infection and prevent bacterial meningitis. Specifically, Plaintiff claimed the infant suffered disabling brain damage and neural hearing loss as the result of a failure to timely vaccinate and perform a sepsis work-up in the face of infant with fever of unknown origin. During trial, our team was able to show, through our clients’ testimony and with the support of superior experts, the care was entirely consistent with the prevailing standard of care. The jury returned an unanimous verdict of no negligence.
