Saxton & Stump’s Insurance Law Group regularly counsels clients in a multitude of industries on questions of insurance coverage and litigates these matters in state and federal court. Chair Michael Traxler brings decades of experience helping businesses navigate bad faith, coverage and first party claims involving commercial and professional lines of insurance. Attorney Seth Mendelsohn provides regulatory experience from his service as the executive deputy commissioner of the Pennsylvania Insurance Department. The team also includes attorney Carson Morris, who previously served as a deputy attorney general in the Pennsylvania Office of Attorney General’s Appeals and Legal Services Section, where he regularly handled matters involving the intersection of civil/regulatory law and criminal law. Overall, the team include attorneys who regularly speak and write on the latest industry topics and are active members of Pennsylvania Association of Mutual Insurance Companies, Pennsylvania Motor Truck Association and Pennsylvania Manufacturers Association.

Insurance Coverage

Drawing on our attorneys’ extensive litigation backgrounds, the Insurance Group has litigated declaratory judgment actions and questions of insurance policy contractual interpretation throughout Pennsylvania. We have handled coverage litigation for businesses in matters pending between insured and insurer, between two primary insurers disputing coverage responsibilities and disputes between primary and excess carriers.

Insurance Bad Faith

The threat of a bad faith claim is prevalent in coverage disputes and litigation. We defend insurers from claims asserting extra-contractual remedies under the Pennsylvania bad faith statute and common law and we also have experience working with insureds to utilize the protections of the bad faith law to secure insurance coverage.

Enforcement Actions and Market Conduct Investigations

Our team regularly handles a wide range of white-collar investigations or enforcement actions, including those related to insurance and financial markets.  We provide guidance to companies facing market conduct investigations and enforcement actions to help achieve the best outcomes for each business’ objectives and situations.
