We represented a gastroenterologist in a case involving a colectomy and colostomy necessitated by a colonic perforation following a colonoscopy. The plaintiff had claimed that the physician deviated from the standard of care by performing a colonoscopy that was contraindicated due to a recent episode of acute diverticulitis. Our litigators proved that, contrary to the plaintiff’s claims, the perforation was unrelated to diverticulitis, that size, nature, and location of the perforation was inconsistent with scope trauma, and that the perforation was caused by the natural progression of the buildup of stool due to severe constipation. As a result, a defense verdict was returned on behalf of the gastroenterologist and his practice.
