LOAN ORIGINATION AND CLOSINGS
We partner with lenders throughout the entire loan origination process from application to closing. We draft and negotiate loan documents, review due diligence, and coordinate closings. We have knowledge of and experience with various commercial and residential loan types.
LOAN MODIFICATIONS AND FORBEARANCE AGREEMENTS
We work with lenders to modify documents while preserving their collateral. Modifications can be as simple as a minor change in terms to more complex changes in the structure of the loan.
Our clients are positioned for favorable outcomes in unfavorable situations. When borrowers do not uphold their responsibilities in a lending situation, banks are forced to modify the loans or charge-off the remaining balance. We support lenders in negotiating loan modifications that alleviate loss.
COLLECTION, ENFORCEMENT, AND FORECLOSURES
In the instance that a borrower is unable to fulfill their obligations, collections, enforcement, or foreclosures may be necessary. We work with clients to collect payments from borrowers who have stopped repaying their loans. We are experienced with various avenues of collecting unpaid debt including garnishments, liens, and foreclosures.
If borrowers are trying to avert the possibility of foreclosure, we prepare forbearance agreements and workouts between lenders and delinquent borrowers.
ADMINISTRATION AND SALES OF REO PROPERTIES
After a foreclosure occurs, the involved property becomes REO – or Real Estate Owned. We work with lenders to manage and sell properties in the lender’s portfolio. We are experienced in reviewing offer contracts, examining deeds, preserving entitlements, and handling title issues.
